NJ: Updated GIT/REP Forms

Please be advised that the Division of Taxation has recently posted revised GIT/REP 1, 3 and 4 forms on its website.

As you are aware the New Jersey Gross Income Tax Act enacted in 2004 requires non-resident individuals, estates and trusts selling New Jersey real estate to pay estimated income taxes at the time of the recording of the deed transferring title. To this end the State created several forms which must be annexed to the deed as a prerequisite to recording to either make an estimated payment, reflect an exemption from payment or reflect that payment has previously been made.

The following forms have been updated and bear a revision date of August 2019 (8-19).

Some counties will still be accepting the old forms for the next 1 to 3 months, but we recommend that all real estate closings going forward use the new forms from the Division’s website.
